MASTER TERMS AND CONDITIONS FOR SERVICES & DIGITAL PRODUCTS

Please read these Terms and Conditions ("Terms") carefully before booking a shoot, subscribing to a membership, or purchasing digital products or services from [Your Business Name] ("Company", "we", "us", or "our"). By making a purchase, paying an invoice/deposit, or checking the "I Agree to Terms and Conditions" box on our website, you ("Client", "You", or "Purchaser") agree to be strictly bound by these Terms.

 

SECTION 1: UNIVERSAL TERMS & CONDITIONS

(Applicable to ALL Clients, Services, and Purchases)

1. Payment Terms & Booking Confirmation

  • Payment in Advance: All single shoots, events, custom projects, retainer instalments, and digital products must be paid in full, in advance to secure your booking.

  • No Payment, No Date: Shoot dates, times, and diary slots will not be held, reserved, or confirmed under any circumstances until payment has fully cleared.

  • Strict No-Cancellation & No-Refund Policy: Because booking a shoot reserves dedicated time in our calendar and requires turning down other paid client inquiries, all payments, retainers, and fees are strictly non-refundable. We do not offer refunds for cancellations or change-of-mind.

 

2. Rescheduling Policy

  • 48-Hour Rescheduling Notice: If you need to reschedule your shoot date, you must provide a minimum of 48 hours’ written notice prior to your scheduled shoot time. If you or the Company have booked a studio, you must also pay to reschedule this slot if the venue's studio policy requires it.

  • Late Rescheduling / Forfeiture: Rescheduling requests made with less than 48 hours’ notice may result in the immediate forfeiture of your shoot fee, requiring a new booking and payment.

  • Rescheduling Limit: Where 48+ hours' notice is provided, shoots may be rescheduled once to a mutually convenient date within 60 days, subject strictly to Company availability.

 

3. Shoot Locations & Last-Minute Changes

  • Fixed Shoot Locations: The shoot location agreed upon during your booking/briefing process is final.

  • No Last-Minute Location Changes: You cannot change the shoot location at the last minute or on the day of the shoot due to our strict scheduling, travel logistics, and potential back-to-back client shoots.

  • Studio Hire & Venue Costs: Package prices do not include studio hire or location entry fees. The Client is fully responsible for booking, paying for, and adhering to the times set by third-party venues.

 

4. Travel & Accommodation

  • Included Radius: Travel within a 45-minute driving radius of Crowle (DN17) is included.

  • Additional Travel Fees: Travel beyond 45 minutes of Crowle, DN17 must be pre-arranged directly with the Company prior to booking and will incur additional travel fees.

  • Events, Overnight Stays & Travel Expenses: For custom events, retreats, or long-distance shoots, all travel expenses, mileage, tolls, and accommodation must be paid in advance by the Client. Accommodation must be of a decent, clean, safe, professional standard (comparable to a Premier Inn at minimum), booked directly in the Company's name, and fully confirmed with details provided to us at least 2 weeks prior to the shoot date.

 

5. Punctuality, Late Arrivals, & Preparation

  • Arrival: Clients must arrive 5 to 10 minutes prior to their scheduled start time.

  • Lateness Deductions: All shoots begin and end strictly at the scheduled time. Any lateness by the Client comes directly out of the allocated shoot time. We cannot stay late or extend shoot durations under any circumstances (especially when studio hires or tight daily schedules are involved).

  • Shoot Readiness: Clients must arrive fully camera-ready (hair, makeup, and first outfit done). Doing hair, makeup, or grooming during your shoot session directly eats into your shooting time slot.

  • Outfit Limits: Outfits must be kept to sensible amounts. Do not expect to fit 10 outfits into a 1-hour session.

    • 1-Hour Shoots: Maximum 1–2 outfits.

    • 3-Hour Shoots: Maximum 4–5 outfits.

 

6. Pre-Shoot Consultation Calls

  • Mandatory Attendance: Clients are required to attend their scheduled pre-shoot planning call prior to their shoot session to map out the strategy, shot list, and objectives.

  • Punctuality & Missed Calls: Please attend the call on time. If you miss your scheduled call, it will be rescheduled strictly at the Company’s earliest convenience. Failure to book or attend your pre-shoot call may result in a less productive shoot for which the Company takes no responsibility.

 

7. Deliverables, RAW Files, & Storage

  • Delivery Window: Standard turnaround for edited content is 2 weeks (14 calendar days) post-shoot. Faster delivery is not guaranteed unless an Express Turnaround Fee is explicitly requested and paid for in advance (subject to availability).

  • Delivery Method & Storage Expiry: Deliverables are sent via Google Drive. Assets must be downloaded and saved to your own personal storage within 6 months of your shoot. After 6 months, file storage is not guaranteed, and assets may be permanently deleted from our servers.

  • NO RAW PHOTOGRAPHY FILES: RAW/unedited photography files are NEVER provided under any circumstances. Photography does not work this way; you are purchasing our finished, professionally edited creative work.

  • RAW Video Clips: Where "all raw video clips" are included in your package, these will be delivered via Google Drive alongside your edited files.

 

8. Creative Control, Revisions, & Portfolio Rights

  • Creative Style Acceptance: By booking, you acknowledge that you have reviewed our portfolio/style and are hiring us based on our creative discretion and signature editing aesthetic.

  • Reel Specifications & Edits: Standard reel edits run approximately 6 to 20 seconds long. Reels include basic styling, timing, and transitions.

  • Minor Revisions: Revisions are strictly limited to minor administrative corrections (e.g., text overlay typos). Requests for complete re-edits in a different style will incur additional fees.

  • Portfolio & Marketing Usage: The Company reserves the right to use all produced photos, video footage, and final edits for portfolio display, marketing, social media, and promotional purposes unless the Client explicitly requests an opt-out in writing prior to the shoot (which must be confirmed by the Company in writing and may incur an additional privacy or NDA fee).

 

9. Cancellation by Company & Limitation of Liability

  • Illness / Inability to Attend (Standard Shoots): For Express, Signature, Content 365, and Strategy Sessions, in the unlikely event that the Company is ill or unable to attend your scheduled shoot, we will contact you as soon as possible to reschedule your session to the earliest mutually available date. Refunds are not issued for standard shoot reschedules caused by Company illness/unavailability.

  • Illness / Inability to Attend (Events & Time-Sensitive Shoots Only): For live events, weddings, retreats, or fixed time-sensitive projects where date changes are impossible, the Company will make every reasonable effort to provide a qualified replacement/associate creator of equal professional standard. If a suitable alternative creator cannot be sourced, a full refund for that specific shoot fee will be issued within 10 working days.

  • No Guarantee of Commercial Outcomes: We provide professional visual media services; we do not guarantee specific social media growth, viral reach, sales, or financial outcomes.

  • Limitation of Liability: The Company is not responsible for any indirect loss, business disruption, brand damage, or reputational issues claimed by the Client. Maximum liability for any claim is strictly capped at the total amount paid by the Client for the specific service rendered.

 

10. Zero Tolerance on Misconduct & Abuse

  • Professional Conduct: We are dedicated to providing a safe, respectful, and professional environment. The Company maintains a strict zero-tolerance policy for verbal abuse, harassment, discrimination, threatening behavior, or intoxication by the Client or their guests/attendees.

  • Immediate Termination of Services: If the Client or anyone associated with the shoot exhibits abusive or inappropriate behavior, the Company reserves the right to immediately terminate the shoot or cease work without notice.

  • Forfeiture of Fees: In the event of shoot termination due to conduct or abuse, all payments made are strictly non-refundable, and the Company is under no obligation to deliver any remaining assets or raw footage.

 

11. Guest Consent, Location Policies, & Permitted Access

  • Guest & Attendee Consent: The Client is solely responsible for notifying and securing all necessary media releases, consents, and permissions from any guests, attendees, models, or staff present at the shoot location. The Company accepts no liability or responsibility for claims made by third parties who object to being filmed or photographed.

  • Location Rules & Venue Permits: The Client must ensure that filming/photography is fully permitted at the designated venue or location. It is the Client’s responsibility to check, comply with, and pay for any venue commercial permits, photography passes, or site rules.

  • Inability to Film Due to Site Restrictions: If a shoot is restricted, delayed, or shut down by venue security, site management, landowners, or local authorities due to lack of permission or venue policy violations, the Company is not at fault. In such cases, the shoot time will not be extended or rescheduled, and no refunds will be issued.

 

12. Damage to Company Property / Equipment

  • Equipment Safety: The Client assumes full financial liability for any damage, loss, or destruction of the Company’s equipment (cameras, lighting, microphones, drones, mobile gear) caused by the negligence, recklessness, or deliberate actions of the Client, their attendees, children, or pets during a session or event. Repair or replacement costs will be invoiced immediately to the Client.

 

13. Copyrighted Material & Background Triggers

  • Uncontrolled Backgrounds: The Company is not responsible for background elements outside our direct control at public or third-party locations (e.g., copyright-protected artwork, visible logos, background music that causes copyright flags on social media, or members of the public walking into frame).

 

14. Social Media Platform Changes & Account Actions

  • Platform Dependencies: The Company edits reels and content based on current social media trends, aspect ratios, and platform algorithms. We are not responsible for future platform algorithm changes, layout updates, audio muting due to third-party copyright claims on platform-trending audio, or account restrictions/bans enforced by third-party social media platforms (e.g., Meta, TikTok, YouTube).

 

15. Client Delays in Briefing & Asset Submission

  • Project Stagnation: Where a shoot or project requires initial input, brand assets, or questionnaires from the Client, delays of more than 30 days in providing requested information will result in the project being archived. Reactivating an archived project will be subject to a £50 reactivation fee and current Company availability.

 

SECTION 2: SERVICE-SPECIFIC TERMS

 

A. CONTENT SHOOTS (Express, Signature, & Custom Events)

Applies to: Express Hour Shoot (£249), Signature 3-Hour Shoot (£599), and Custom Quotes.

  • Payment Requirement: 100% full payment must be received in advance to lock in your date.

  • Scope Changes: Any work requested on-site beyond the original specified quote/brief will either require an additional invoice paid prior to deliverable release or will be completed strictly to the original agreed scope.

 

B. CONTENT 365 RETAINER

Applies to: Content 365 (£99/month - 12-Month Commitment).

  • Payment Standing: All monthly recurring payments must be completely up to date.

  • Quarterly Shoot Unlocking Rule: Shoots cannot be scheduled or booked until at least 1 full quarter's worth of payments (3 monthly payments / £297) has been made in full, unless you choose to pay for the quarter upfront in advance.

  • Frequency Limit: Content 365 includes exactly 1 shoot per quarter (4 per year). Shoots cannot be stacked or doubled up in a single quarter unless paid for in advance outside the retainer agreement.

  • Travel: Travel outside the 45-minute Crowle (DN17) zone must be formally requested and pre-approved with additional travel fees paid prior to booking.

 

C. REEL EDITING SERVICES (Standalone & Add-ons)

Applies to: Basic B-Roll Reels, Complex Reels, and Monthly Editing Subscriptions.

  • Client-Supplied Footage Quality: "Bad footage = bad edit." We can only edit what we are given. The Company is not responsible for poor lighting, blurry focus, shaky camera work, distorted audio, or low video quality present in client-supplied raw files.

  • Footage Delivery Expiry & Turnaround Times:

    • Standard Turnaround: Standard turnaround time for reel edits is 14 days from the date all required raw footage and assets are received.

    • Delayed Footage Penalty: All raw footage must be delivered to us within 7 days of invoice payment. If footage is not submitted within 7 days, your turnaround time may be extended based on current schedule availability.

    • 30-Day Expiry: All client footage for standalone editing must be delivered within a maximum of 30 days of invoice payment. Failure to supply footage within 30 days may result in the forfeiture of the booking and payment without refund.

  • Creative Direction & Scope:

    • All notes, creative direction, brand guidelines, audio requests, and specific requirements must be provided at the time of booking/footage submission.

    • Requests for edits based on direction or information not provided in the original brief will be classed as out-of-scope work and will incur additional fees.

    • If client-supplied footage requires excessive clean-up, re-framing, or work beyond the original agreed scope, the Company reserves the right to request additional payment or complete the project strictly to the original basic scope.

  • Amends & Revisions:

    • Packages include 1 round of minor amendments per reel.

    • All amendment feedback must be provided at the same time in a single consolidated list or document within 5 business days of draft delivery. Piece-by-piece or piecemeal feedback will not be accepted.

    • Any additional amendment rounds, late feedback, or edits requested outside the initial feedback submission will be charged as an additional fee and scheduled strictly at the Company's convenience and availability.

 

D. DIGITAL PRODUCTS & STRATEGY CONSULTATIONS

Applies to: Social Style Kit (£99) and Content Audit (£200).

  • Social Style Kit (£99): Digital product template sales are final and 100% non-refundable.

  • Content Audit (£200): Paid in advance. 1-to-1 calls require 48 hours' notice to reschedule. No-shows or cancellations forfeit the session fee.

 

E. EDUCATIONAL SUBSCRIPTIONS (Content School & Content Creator School / Skool)

Applies to: Content School (£77/mo) and Creator School ($7/mo, $33/mo, $99/mo).

  • No Refunds Post-Charge: All recurring subscription charges are strictly non-refundable once processed.

  • Cancel Anytime: You may cancel your subscription at any time prior to your next billing date via your member portal. Access remains active until the end of your current paid billing period.

  • Strict Confidentiality & IP Protection: All content, strategies, templates, scripts, and frameworks inside the School are strictly proprietary. Sharing, distributing, pirating, or screen-recording content inside the school is strictly illegal and will result in immediate removal without refund and legal prosecution.

  • Technical Requirements: Access to platforms, materials, and digital downloads requires an active internet connection and compatible third-party applications (e.g., Skool, Canva, Zoom, Google Drive). The Company is not liable for access issues resulting from Client hardware limitations, user error, or third-party outages.

 

SECTION 3: ACKNOWLEDGMENT & AGREEMENT

 

By proceeding to complete your payment, signing your invoice, or checking the agreement box at checkout, you confirm that you have read, understood, and voluntarily agree to all the Terms and Conditions outlined above.
